This is a short summary of the text of the law. Details, quotations of articles and links to the official texts are below. The visa-free stay depends on your citizenship, and amounts and lists of countries are set by secondary acts, so check them on the date of your decision.
Many foreigners come to Turkey without a residence permit and want to understand what they may do. The rights of a foreigner without a residence permit in Turkey are determined by Law No. 6458 on Foreigners, Law No. 2644 on Land Registry, the Civil Code and the Constitution. Below is gathered what the law directly allows and forbids a person who is in the country on a visa or under the visa-free regime, and where to check the periods for your citizenship.
The material is for information and does not replace advice from a lawyer. Questions of banking, medicine, renting and work will be covered in separate articles of this section, so here there is only what is confirmed by the text of the law.

The right to enter and stay without a residence permit
Article 5 of Law No. 6458 requires people to enter and leave through border crossing points with a valid passport or a document that replaces it. Article 11 sets the general rule: the period given by a visa or the visa-free regime may not exceed ninety days in every one hundred and eighty. Article 20 directly exempts from a residence permit those who came on a visa or without a visa for up to ninety days, for the period of the visa or visa-free regime.
“Doksan güne kadar vizeyle veya vizeden muaf olarak gelenler, vize süresi veya vize muafiyeti süresince” (Article 20, paragraph 1a). Those who came on a visa or without a visa for up to ninety days are exempt from a residence permit for the duration of the visa or visa-free regime.
The passport must also be valid for at least sixty days after the end of the permitted stay; otherwise, under Article 7, entry may be refused.
The right to own property
A residence permit is not needed to buy property. Article 35 of Law No. 2644 allows foreigners whose countries are on the President’s list to acquire property, and Article 35 of the Constitution says that everyone has the right of ownership and the right of inheritance. The Civil Code (Article 8) provides that every person has legal capacity. The restrictions by list of countries and by area limits remain; they are analysed in the article “Which laws regulate the purchase of property by foreigners”. But the fact of buying does not give the right to live in the country longer than the visa period: for that a residence permit must be obtained (Article 19).
“Herkes, mülkiyet ve miras haklarına sahiptir” (Constitution, Article 35). Everyone has the right of ownership and the right of inheritance.
The right to judicial protection
A foreigner who has no residence permit can appeal decisions of state bodies. Article 101 of Law No. 6458 speaks of applying to the administrative court, and Article 53 gives seven days to appeal a deportation decision from the day of service. The decision is served on the foreigner, their legal representative or lawyer, and must explain the procedure and time limits for appeal. Until the time limit for applying expires, or until the proceedings end, the person is not deported unless they consent.
What may not be done without a residence permit
- Staying beyond the period. Anyone who stays longer than the visa period or longer than ninety days must obtain a residence permit (Article 19). Overstaying a visa or visa-free regime by more than ten days is among the grounds for deportation (Article 54).
- Working without a permit. Working without a permit is named in Article 54 among the grounds for deportation. A residence permit does not replace a work permit, and the conditions of issue are determined by Law No. 6735.
- Using false information. Using false information and forged documents on entry, in a visa or a residence permit is also a ground for deportation (Article 54).
- Counting on special rights. The rights that the law links with a long-term residence permit, for example equality with citizens in a number of areas (Article 44), do not arise without it.
Residence permit: when it is mandatory
If you plan to stay longer than ninety days, a residence permit is mandatory. Under Article 19 the permit loses its force if you do not start using it within six months. The grounds are listed in Article 31: property, study, business ties, treatment, tourism, Turkish language courses and others. More in the article “What rights arise after obtaining a residence permit” and in the analysis of Law No. 6458.
What remains outside this article
We do not write here about a bank account, medical care, renting housing and connecting utilities, because they need separate rules and practice. These questions are in the list of this section (banks: questions 300–317, medicine: 351–365, renting: 401–420). As soon as the relevant articles appear, the questions in the list will become links. Look at property options in the catalogue.
Can a foreigner buy a flat without a residence permit
Yes, a residence permit is not needed to buy: Article 35 of Law No. 2644 makes the condition the citizenship of a country on the President’s list, and not a residence permit. But the deal needs numbers: the tax number of each party is entered in the official deed (Article 26 of Law No. 2644), and the procedure for issuing a foreigner’s identification number is analysed in article No. 27. A flat that has been bought does not give the right to live in the country longer than the visa period or the visa-free stay: for that a residence permit is needed (Article 19 of Law No. 6458).
Conclusion
Without a residence permit a foreigner may enter on a valid passport, stay in the country for up to ninety days in a hundred and eighty, buy property provided their country is on the list, and appeal decisions in court. They may not stay beyond the period, work without a permit or use false documents. Check the period of visa-free stay for your citizenship and the current list of countries before a deposit.
